Maine authorities have moved to criminally charge a father following the death of his infant daughter in a freezing bedroom. The arrest, which took place last week, marks a legal escalation in a case that had previously been handled through administrative review.

The first key point involves the specific circumstances of the death. James McLaughlin told NEWS Center Maine that he discovered his 13-month-old daughter, Eleanora, dead in their Milford home last December. He described finding the room cold after a pet opened the door, allowing heat to escape from a space heater. McLaughlin stated that he could see his own breath and found the child after waking her with a package of Pop-Tarts.

The second key point concerns the family's history with state officials. Maine State Sen. Jeff Timberlake revealed that records obtained by his office indicate the Department of Health and Human Services had investigated the couple multiple times. McLaughlin confirmed these investigations date back to 2017, although he disputed the findings. His estranged wife, Erika Dupuis, who relocated to West Virginia in the summer of 2025, expressed anger that criminal charges were not filed sooner.

The third key point details the current legal status of the case. McLaughlin was taken into custody and held at the Penobscot County Jail. He is scheduled to appear at the Penobscot Judicial Center. Timberlake described the filing of manslaughter charges as long overdue, reflecting the legislative interest in the outcome of the prior administrative probes.

The death certificate lists hypothermia as the cause of death. While the specific conditions leading to the charge were not immediately detailed by officials, the shift from health department oversight to criminal prosecution signals a change in how authorities view the incident.
