Cassidy Hutchinson is not facing criminal charges.
A federal grand jury in Washington, D.C., declined to indict the former White House aide on Tuesday. The Justice Department had sought criminal charges against her. The prosecution focused on statements she made to Congress in 2022. Two sources confirmed the outcome to Fox News Digital.
The legal team argued that Hutchinson lied to the House select committee. The committee investigated the Jan. 6, 2021, Capitol riot. The grand jury rejected the indictment. It is not yet known if federal prosecutors will try again to secure charges.
Hutchinson served as a top aide to Mark Meadows, the former White House chief of staff. She became a central figure in the congressional inquiry. Her role involved examining President Donald Trump's actions during the election certification process.
She appeared before the committee in June 2022. The hearing was broadcast on national television. Hutchinson described Trump's reaction on Jan. 6. She recounted a conversation she said she heard from another official. That official told the president he could not travel to the Capitol. Other people familiar with the events have disputed her account of the confrontation inside the vehicle.
The Justice Department investigated possible false statements. A federal grand jury heard evidence regarding these claims. A source previously noted that more evidence could be presented as soon as the following week. No final decision had been reached at that time. The New York Post also reported on the ongoing investigation.
The grand jury decision does not prove her testimony was true or false. Hutchinson has maintained that she stands by her statements. Fox News Digital contacted the Justice Department for comment. The office of Rep. Barry Loudermilk also received a request for comment. The office of Rep. Bennie Thompson was also contacted.
